Brett J. Marshall, Esq. is an attorney licensed in the State of Nevada and 9th Circuit District Courts since 2004. His primary areas of practice are Real Estate and Corporate Law.
Mr. Marshall’s emphasis in Real Estate has primarily focused on representing residential and commercial real estate owners to restructure loans and prevent foreclosure. Since the real estate collapse in 2007, Mr. Marshall has fought diligently against bank foreclosures and has successfully saved more than 1,000 homes from foreclosure in the State of Nevada through litigation (seeking damages, specific performance, injunctions and declaratory relief), home loan modification, commercial loan restructuring, purchases of non-performing notes, and continues to represent clients through litigation and representation through the State of Nevada Foreclosure Mediation Program. Mr. Marshall also became well versed in title disputes and bankruptcy law as bankruptcy was often used as a measure of last resort for clients to attempt to save their homes and restructure their debt. He has also represented people in Landlord/Tenant disputes and settled matters of taxation with regard to the foreclosures / short sales and other tax matters.
Mr. Marshall’s second emphasis is Corporate Law and Transactional matters. For many years he has counseled businesses on matters such as: business and breach of contract litigation, business formation & structure; operating agreements and articles of incorporation; contract preparation and negotiations; commercial litigation; dispute resolution; counseling on matter of employment; employment agreements; restructuring business debt; and raising corporate financing.
Prior to attending his undergraduate studies, Brett Marshall proudly served his country as an enlisted man in the United States Navy quickly obtaining the rank of Second Class Petty Officer aboard the USS Fox (CG-33), a guided missile cruiser stationed in San Diego, CA. During his military service, he was awarded the Armed Forces Expeditionary Medal, National Defense Medal, Good Conduct Medal, and received a Letter of Commendation for outstanding performance and professionalism during a six-month deployment to the Persian Gulf. After his Honorable Discharge, Mr. Marshall returned to his hometown of El Paso, Texas and attended the University of Texas at El Paso where he obtained his Bachelor’s Degree in Criminal Justice.
In 2001, Mr. Marshall began his legal studies at California Western School of Law in San Diego, CA, choosing to accelerate his studies, he obtained his Juris Doctorate in just two years and was admitted to the Nevada State Bar and all 9th Circuit Federal Courts in 2004.
